art.1 General

General terms and conditions of Oleksandr Polovyna (TopNalis PRO) with registered office at Driftweg 189 b.0202 , 8450 Bredene, Belgium (VAT: BE0671960768)

These terms and conditions apply to all transactions concluded with Oleksandr Polovyna (TopNalis PRO) . Please read them carefully before placing an order. All agreements are subject to and shall be interpreted in accordance with Belgian law. All disputes will be dealt with exclusively in the Belgian courts in Bruges. Nothing in these general terms and conditions shall be deemed to affect your statutory rights.

By placing an order, both via the website and by other means, you agree to these general terms and conditions. All transactions with Oleksandr Polovyna (TopNalis PRO) are subject to these general terms and conditions.

By “the company”, “we” or “us” you always refer to Oleksandr Polovyna (TopNalis PRO). Customer” or “you” or “your” refers to the person or persons who purchase goods or agree to purchase goods from the Company. Any reference to the website implies a reference to all URLs owned by Oleksandr Polovyna (TopNalis PRO).

art.2 Prices

All prices are in euro. All prices are standard excluding VAT, unless explicitly stated otherwise. All prices are subject to change without notice.

art.3 Orders

To purchase a product you must first add the product to your shopping cart. Once you have added the desired products to your shopping basket, you can enter your contact and invoicing details. You will then need to provide us with the necessary details to pay for the products. If we have received all the above data, you will receive an overview page. If you accept it, your purchase is final. The purchase agreement can be concluded in the language of the website in which you buy.

We accept orders via online transactions (secure server). All credit and debit card transactions are subject to validation checks and approval by the card issuer. We accept Credit Card, PayPal, Maestro, Bancontact/Mister Cash, KBC Online/CBC Online, ING Homepay, Dexia Direct Net, iDEAL and Sofort Banking. If the issuer of your card refuses to accept your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without a valid payment in the name of the registered cardholder will not be accepted or processed.

We also accept orders by bank transfer. An order by bank transfer will be reserved for you for three working days. If the payment does not reach us on the account number you receive from us in the email with the order confirmation within three working days after placing the order, the order will be cancelled. Your order can in no case be processed before payment is received by us.

P>Please note: minors (under 18 years of age) are not allowed to purchase unless they have permission from their parents or guardian.

art.4 Delivery

Ordered products will be delivered as soon as possible according to the requested delivery method. All delivery costs are subject to change without prior notice. We make every effort to ensure that you receive your order within the estimated delivery time. The maximum delivery period is 30 days, counting from the day after your order. All goods are delivered subject to their availability. Promotions always run for the indicated period or as long as stocks last. If we are unable to deliver your goods within 30 days, we will inform you immediately and inform you of the expected delivery date. If we are unable to deliver the goods within 30 days, you may cancel the undelivered orders/products at any time after you have been informed of the late delivery. If payment has already been made, you will receive a full refund for the item(s) in question. If the goods delivered by us have been damaged during transport, do not correspond to the items mentioned on the delivery note or do not correspond to the items you ordered, you must report this and return the items to us within 14 calendar days of their receipt. If we do not receive such notification, the customer will be deemed to have accepted the items as satisfactory. We cannot be held responsible for any consequential damages due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases shall be limited to the value of the items shown not to have been received by the customer.

art.5 Returning and exchanging articles

We want you to be fully satisfied with every purchase from Oleksandr Polovyna (TopNalis PRO) and strive to offer you excellent quality, value for money and excellent service at all times. If you wish to return an item for an exchange, or if you have decided not to keep it, please complete the return note you received upon delivery and return it to us within 14 calendar days, together with the products in their original packaging and with the label. When appropriate, we will exchange the item(s) or refund the cost price. All goods must be returned in new and unused condition, together with a copy of your original delivery note.

If you wish to return an article because it is damaged, please fill in the details on the return note with a description of the damage and return it to us within 14 calendar days together with the article in its original packaging. When appropriate, we will exchange the article or refund the full cost price, including all incurred delivery costs. The customer is responsible for the shipment of the goods.

art.6 Warranty

All products are guaranteed against defects resulting from manufacturing or material faults. The warranty lasts 24 months from the date of placing the order (unless otherwise stated). Defects caused by accidents, negligence or misuse are not covered by the guarantee.

If you have received a product in a damaged condition, please inform us first. You can contact us via [email protected]. We will see how we can offer a solution and will ask you to return the item. In this case, the return costs will be refunded (according to the standard postal rates). Please send the damaged product, together with the return note and a description of the damage, sufficiently stamped to our return address. Also add your account number, so we can make the refund.

Please also clearly indicate what is wrong with the purchased product, or indicate where something is wrong. All items should be returned to us in a neat and tidy condition, so we can help you as soon as possible.

art.7 Products

All products are only sold, unless otherwise stated, and are not always available at every point of sale. We make every effort to ensure that the colours on the website match those of the actual product as closely as possible. Due to technical limitations, certain colours may vary.

art.8 Regulations on Distance Selling – Right of Withdrawal

In accordance with the distance selling regulations, you have the right to cancel, within 14 calendar days from the day after the delivery date, any order you have placed via the website for a refund, provided the goods are unused. This does not apply to perishable goods, unsealed software or items personalised or made according to your instructions. For services, the delivery of the service has not yet taken place at the time of revocation.

Reversion right

You have the right as a private customer to revoke the agreement within a period of 14 days without giving reasons. The revocation period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, acquires physical possession of the last good. For services, this is the day after registration via the website.

In order to exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). You may use the attached model revocation form for this purpose, but you are not obliged to do so.

In order to comply with the revocation deadline, it is sufficient to send your communication concerning your exercise of the right of revocation before the revocation deadline has passed.

Following the revocation

If you revoke the agreement, you will receive back from us all payments you have made up to that moment, including delivery costs (with the exception of any extra costs resulting from your choice of a method of delivery other than the cheapest standard delivery offered by us) immediately and in any case no later than 14 days after we have been informed of your decision to revoke the agreement. We will refund you by the same means of payment with which you carried out the original transaction, unless you have expressly agreed otherwise; in any event, you will not be charged any costs for such refund.

We may defer repayment until we have received the goods back, or you have proved that you have returned the goods, whichever comes first.

You must return or hand over the goods to us immediately, but in any event no later than 14 days after the day on which you have notified us of your decision to withdraw from the contract. You will be on time if you return the goods before the period of 14 days has expired.

Revocation for business clients

As a business customer, you can use the right of withdrawal as described above for the purchase of products, albeit that only the returned goods will be credited. All costs related to the sale, such as payment and shipping costs, are at the expense of the customer. For the purchase of services, business customers cannot revoke the agreement.

art.9 Force majeure

We are not responsible for the non-fulfilment of our obligations if this is the result of, or is caused by labour disputes or any other circumstances that are reasonably beyond the control of the company, such as cases of force majeure, riots and disturbances, flooding, fire, strike, lock-out, difficulties in finding transport and the enactment of laws. If, due to such circumstances, it becomes impossible for the company to deliver all or part of the ordered articles within a reasonable period of time, the liability of the customer shall be limited to the value of the articles already delivered, plus any associated delivery costs.

All information contained on our website(s) or that can be read on any of the company’s printed material is not considered compelling or recognised as best practice. It should only be considered as useful additional advice in addition to other recognised best practice guidelines. All information on our website is regularly updated.

We check prices and specifications to the best of our ability. Although we make every effort to ensure that they are correct, we accept no responsibility for errors and omissions. We reserve the right to change our prices and specifications without prior notice.

art.12 Ownership of goods

All items delivered to the customer remain the property of Oleksandr Polovyna (TopNalis PRO) until payment of all amounts due for the items in question has been received by us.

art.13 Questions or complaints

All questions, complaints or comments can be sent to our customer service via [email protected]. We will make every effort to deal with your complaint within 5 working days of receipt. If we are unable to resolve your complaint immediately, we will inform you of the likely time limit. We will keep you informed of any investigation.

You can also report complaints and disputes via the European ODR (Online Dispute Resolution) Platform. The ODR website is http://ec.europa.eu/odr.

We make every effort to protect the safety of the users of our online ordering service as much as possible. We use SSL (secure socket layer) technology to secure your data during all sales transactions with us. All information you provide is fully encrypted so that third parties cannot read it.
